This document outlines the standard procedure and narrative for how we collect, verify, and manage consumer consent to receive SMS/text messaging, in strict compliance with standard telecommunications and messaging regulations.
Consumers provide their explicit consent to receive messages via our online intake and registration forms located on our website (e.g., at [Insert Your Website URL]). When a consumer requests information or registers for our services, they are presented with a secure web form to enter their contact details, including their mobile phone number.
To ensure consent is explicitly given, we do not rely on implied consent or pre-checked boxes. Directly below the phone number input field, the form features an unchecked, optional checkbox accompanied by clear and conspicuous disclosure language:
"By checking this box and submitting this form, you explicitly consent to receive SMS/MMS text messages from [Insert Business Name] at the phone number provided. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. You can unsubscribe at any time by replying STOP. Please review our [Privacy Policy URL] and [Terms of Service URL]."
- Active Consent: The consumer actively reads the disclosure and manually checks the opt-in box.
- Submission & Logging: Upon clicking "Submit", the system captures the consumer's data. The timestamp, IP address, and positive consent status are permanently logged in our database alongside the consumer's profile to serve as an audit trail.
- Initial Acknowledgment: The first message sent to the consumer upon opting in clearly identifies our business and reiterates the opt-out instructions.
Consumers maintain the right to revoke their consent at any time. Our system is automated to honor opt-out requests immediately.
- Keywords: Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any of our text messages automatically updates the database to block future messages.
- Confirmation: Upon opting out, the consumer receives one final automated confirmation message acknowledging the removal, after which all promotional or informational messaging ceases.
