What is for sale?
The original works were financially inert. They were posted out on the web for anyone to see them.
An artist sees the works, likes them.
Takes those selected works, enlarges, fine-tunes, prints, frames, and displays the works inside a context.
The artist then puts those pieces on display and for sale.
What is for sale?
Is the original photo what is for sale?
Is the print and the context the print is put into what is for sale?

The work that the artist performed:

  • Seeking out interesting materials.
  • Conceiving a context for those materials.
  • Structuring the materials into the context.
  • Altering the materials for display.
  • Printing and publishing the materials for consumption.

Should the artist financially compensate the original creators? That's a good question.

Is the artist trying to represent the essence of the photos OR are they simply re-posting the images for sale?

What's the artistic merit and intent? It's a dubious question that legal experts have trouble with. I don't have an answer.

I can be certain though that an attempt to pay the original creators would open up a can of worms. Copyright? Ownership? Co-ownership? Co-creation? Who is the artist?

Is the photo the "subject" of the art or is the photo the art itself?
