Concerning the questions if it is legal: It depends. Microsoft only wants you to have a valid license if you use their products. If the online activation is not working (e.g. because you activated a license too quick behind each other) but you have a valid license it would be okay. If you don't have a license of course it is not.
As already mentioned: It would be easily possible for Microsoft to fix this but they don't, so I think Microsoft does not prioritize on this thing and they live with it. Also as Microsoft is operating GitHub they would already have removed any suggestion on this topic if the really would like to prevent it.
