Summary of the Kraken/Spyder issue
1. In Spyder affidavit he claimed to be a "military defense analyst"
2. It was widely reported that Spyder had lied about his background as a military defense analyst.
3. The federal court has a rule that says lawyers have to check the details of evidence before they submit it to court (Federal Rule 11)
4. The Kraken lawyers signed to say that they had followed that rule.
5. When the judge asked the Kraken lawyers who had spoken to Spyder, only one person put his hand up (Klienhandler).
6. When the judge asked Klienhander if he checked Spyder's background, Klienhandler admitted that he did not.
7. When the judge asked Klienhandler if he informed the court when it became widely reported that Spyder had lied, Kleinhandler admitted that he had not.
8. Failing to check the evidence, and then failing to inform the court when news made the evidence questionable are both sanctionable breaches of Rule 11.
